Q: Why do I need a lawyer to help me collect disability benefits?

Q: What is your fee for handling my disability case?
A: We handle all Social Security disability cases on a contingency fee basis. You only pay attorneys’ fees when we get you benefits. When our Oakland and Sacramento Social Security Disability lawyers are successful, we receive a fee calculated as a percentage of your past-due benefits. For SSD and SSI disability claims, the fee is established by law at 25 percent. All future benefits are yours to keep in full.
Q: When do you start charging me costs?
A: You do not incur any costs until we sign an agreement to work together. Our firm offers a thorough initial consultation free of charge. If we agree to represent you, we advance our costs as we begin work on your behalf. You do not reimburse us for our costs until your case is closed.
Q: What if I already have an attorney?
A: If you are not satisfied with your current representation, you have the right to terminate that relationship and seek the counsel of David Allen & Associates. You will owe your previous attorney reasonable payment for any work that has been done for you. We can usually pay your former attorney from our fee if we succeed in helping you obtain Social Security Disability benefits. Your previous disability lawyer may demand immediate payment for costs that were advanced. Our firm can help you determine how to handle such requests for payment.
Q: How long will it take for my case to be resolved?
A: Disability claims can take several years to make their way through the complex process of denials and appeals. However, our Social Security Disability attorneys help speed up your case as much as possible. We seek expedited hearings when appropriate and we are proactive at all times.
