What Is A Disability Claim?

Disability Insurance provides benefits if the insured is disabled for any reason. Disability insurance carriers frequently deny claims. With over 44 years of experience we are here to help you through the quagmire of obtaining benefits.

My Claim is Denied?

Most claims are denied. Insurance companies are businesses. They exist to make money. If you get denied, don’t walk away from your claim, get help with it.

In most cases your appeal is your one and only chance to present your claim. When you go to court you often can only present the material you presented in your appeal.

This is because the majority of disability policies are employer-sponsored. Under the law which governs them the court can only consider what is in the insurance claim file. Once your appeal is submitted it becomes part of the claim file. The materials submitted through your appeal are many times the only things supporting your claim. This is why well done appeals can be several hundred pages long. The judge can only consider these materials. The judge cannot speak to your doctors, or witnesses, or even you.

If your appeal is denied, as many are, the next step is commonly federal court. Here the judge can consider the materials submitted in your appeal. If your appeal was completed by an attorney skilled in disability insurance there is a good probability your claims will be approved.

David AllenCoverage

You can obtain coverage for disability insurance two ways. One is to buy an individual policy. The other, and by far the more common, is as a benefit of employment. Employee Benefits are governed by a Federal Law called ERISA. If you are wondering if you have coverage through work, ask your Human Resources or Employee Benefits contact. Many people do not even realize they possess coverage until they ask.

David AllenOther Kinds of Insurance Claims

David Allen & Associates also assists with claims brought under Accidental Death & Dismemberment policies. These claims, as do all insurance claims, hinge on the policy, a contract between the company and either you, or your employer. The specifics of the contract, and the language in which it is written, can make or break your claim. Our firm was founded over 40 years ago by David Allen after he first spent years in the insurance industry. His experience makes him particularly familiar with the way in which policies are written and the manner in which the industry functions.

David AllenMaking an Insurance Disability Claim

Initially making a claim is fairly straight forward. Your employer fills out a form, your doctor fills out a form, and you fill out a form. It then becomes complicated. When the insurance company receives these three opening documents it sends you a second batch of forms. The insurance company may order your medical records, or it may request you obtain them. When you return all the things the company asks for, you wait. You wait for what seems like an unreasonable amount of time. Then you may get a decision, or you may get a request for more information. Someone familiar with the process can be of tremendous help and may be able to achieve approval of your claim before the insurance company issues a standard denial.

What Is ERISA?

Many people are insured for disability under policies provided by their employer. Lots of people don’t even realize they possess coverage until a disabling condition attacks. Employer-sponsored disability policies are governed by the Employee Retirement Income Security Act (ERISA).

ERISA was enacted to ensure employees receive the benefits promised by their employers, including long-term disability coverage. When your employer-sponsored LTD claim is denied, you possess rights under ERISA. Many law firms do not handle ERISA cases because they are difficult. The disability attorneys at David Allen & Associates possess extensive experience with ERISA claims.

What the Insurance Company Won’t Tell You.

If your insurance company denied or terminated your long term disability benefits, there is a very important fact to be aware of. It is a fact insurance companies fail to disclose. They prefer you don’t know.

Under the federal law known as ERISA (Employment Retirement Income Security Act), once an appeal is submitted in an attempt to reverse an adverse decision from your insurance company, there is no other opportunity to add items to your claim file. For example, if your insurance company reviews your appeal and maintains its decision to deny or terminate your benefits, you cannot submit any additional evidence – EVER.

You can file suit in federal court, but again – you cannot add any other supporting documents to your file. You cannot testify before the court. You cannot call witnesses on your behalf. The court will only rely on the evidence you presented during the appeal stage, regardless of any updates in your medical condition.

It is a very critical point in your claim.

With the abundance of material you must gather to present a cohesive and detailed appeal, we strongly urge you to contact our experienced legal team for assistance in perfecting your appeal. We have countless years of experience with insurance companies and the way that they conduct business. They can be misleading and calculated. You are left with little chance to persuade a medical reviewer, adjuster, or judge that the company is obligated to pay your claim.

Most policies require you to apply for Social Security Disability when you bring a claim under the policy. Many companies will provide a “free” attorney to assist you with your Social Security disability application. In reality the attorney is not “free” but paid through benefits withheld by the Social Security Administration withholding attorneys fees from benefits provided under Social Security law.

Our firm possesses a team which handles Social Security Disability claims. They work in conjunction with our Insurance Disability Team. Unlike lawyers hired by a disability insurance company our lawyers possess an obligation to work for you, and only you. We will coordinate and maximize the benefits available to you under Social Security with the benefits available under your disability policy. We guarantee the fee for the Social Security disability representation will be exactly the same as the “free” attorney hired by the disability insurance company. This means you will pay nothing out of pocket for attorneys’ fees.

Insurance companies write the policies, collect the premiums and want to keep the money. It is a long hard struggle going it alone. Contact us today for a free evaluation which can change your life.
